Notice: DeedGraph was previously known as Parcel (and earlier as OwnerIntel). The operating entity, data practices, and your rights under these terms remain unchanged.
1. Introduction
These Terms of Service (“Terms”) govern your use of DeedGraph, a building intelligence data service operated by NEXARLABS LTD, company number 16703034, registered at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ (“we”, “us”, “our”).
By using our website or purchasing data from us, you agree to these Terms. If you do not agree, please do not use our services.
2. Service Description
DeedGraph provides commercial real estate owner intelligence data, including:
- LLC ownership resolution (tracing LLCs to real individuals).
- Distress scoring and vertical-specific signal layers.
- Contact channels as filed in public records, and, when you run a report, web-found contacts labeled by source.
- Decision-maker tiering and enrichment.
Our data is designed for use by facade contractors, CRE lenders, debt funds, brokers, tax appeal firms, trade contractors, and other professionals in the commercial real estate industry.
3. Account Terms
When you request data or place an order through DeedGraph:
- You must provide accurate and complete contact and company information.
- You are responsible for maintaining the confidentiality of any account credentials.
- You must be at least 18 years old and have the authority to enter into these Terms on behalf of your organization.
- One person or organization may not maintain multiple accounts for the purpose of circumventing order limits or pricing.
4. Payment Terms
- Data is priced on a per-record or subscription basis. Pricing is displayed on our website and may be updated from time to time.
- Payment is processed through Stripe. By submitting payment, you agree to Stripe's terms of service.
- All prices are quoted in US Dollars unless otherwise stated.
- Payment is due at the time of order.
5. Refund and Replacement Policy
Delivered records are non-refundable. Once data has been delivered to you, we cannot issue a refund for that data.
Replacement policy: If any record misstates a public filing we cite (wrong entity, or a channel that does not match the cited record), we will correct it at no cost. Replacement requests must be submitted within 30 days of delivery.
“Incorrect” means factually wrong at the time of delivery, not “they didn't respond.”
Non-pierceable LLCs: Some LLC ownership chains cannot be definitively resolved due to complex corporate structures, foreign trusts, offshore entities, or jurisdictions that do not require beneficial ownership disclosure. If after exhaustive research we cannot identify a beneficial owner, we will either refund the cost of that specific record or replace it with another building matching your criteria. In either case, we will deliver research notes documenting the ownership trail and where it ended.
Undelivered orders: If we are unable to fulfill your order, you will receive a full refund.
6. Data Usage Rights
When you purchase data from DeedGraph:
- You may use the data for your own business operations, including outreach, compliance consulting, and client prospecting.
- You may incorporate our data into reports, proposals, or presentations for your clients.
- You may not resell, redistribute, or sublicense the raw data to third parties.
- You may not use the data to build a competing database or data product.
- You may not use the data for any unlawful purpose, including harassment or spam that violates applicable regulations.
- You are solely responsiblefor ensuring any call, text message, or email you send using contact information obtained through DeedGraph complies with the Telephone Consumer Protection Act (TCPA), the federal and applicable state Do-Not-Call rules, the CAN-SPAM Act, and all other applicable marketing and communications laws. DeedGraph does not scrub contacts against Do-Not-Call registries and grants no consent on any contact's behalf.
These restrictions survive termination of your account or relationship with us.
6a. Entity-Level Scoring Only
DeedGraph is a commercial real estate intelligence product. All risk tiers, payment-risk tiers, distress tiers, and other derived signals describe entities (LLCs, buildings, portfolios), not natural persons.
Our data is nota consumer report as defined by the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) or any analogous state law. You agree that you will not use our data or any derived score to make decisions about any individual's eligibility for credit, employment, insurance, housing, tenancy, or any other FCRA-covered purpose. You are solely responsible for ensuring your use of our data complies with the FCRA, state consumer-reporting statutes, and all other applicable law.
California residents: your personal information may be included in DeedGraph's records if you are the beneficial owner of NYC commercial real estate. You have rights under the CCPA/CPRA including the right to know, correct, and delete. Requests can be submitted via the contact address on our Privacy page.
6b. Permitted-Use Certification and Audit
By purchasing or accessing DeedGraph data, you certify on each use that you will use the data solely for commercial real estate business purposes and not for tenant screening, employment screening, personal credit or insurance underwriting, or any other purpose covered by the Fair Credit Reporting Act or analogous state law, and that you are not acting as a consumer reporting agency with respect to our data.
You agree to maintain reasonable records of your use of the data and, on reasonable written notice, to allow us or our designated auditor to verify your compliance with these Terms. We may suspend or terminate your access immediately, without refund, if we reasonably determine you have used the data for a prohibited purpose. This certification survives termination.
7. Data Accuracy
We make every reasonable effort to verify the accuracy of our data through multiple public and proprietary sources. However:
- We do not guarantee that all data is 100% accurate, complete, or current.
- Building ownership, distress signals, and contact information can change. Our data reflects the most recent information available at the time of delivery.
- Some LLC ownership chains are legally or practically unable to be fully resolved. We make no guarantee that every building will yield a beneficial owner. Our data is designed for buildings with traceable ownership; opacity or jurisdictional complexity may result in incomplete data.
- You are responsible for independently verifying critical information before making business decisions based on our data.
- Contact details (email addresses and phone numbers) are algorithmically inferred from public and commercial sources and probabilistically verified. They are not authoritative, and may be inaccurate, out of date, or associated with a different individual. Verify them before relying on them.
Our replacement policy (Section 5) is your sole remedy for inaccurate data.
8. Limitation of Liability
To the fullest extent permitted by law:
- NEXARLABS LTD is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our data or services.
- Our total liability for any claim related to our services shall not exceed the amount you paid to us in the 12 months preceding the claim.
- We are not responsible for losses arising from your reliance on our data without independent verification.
Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under English law.
9. Intellectual Property
All content on the DeedGraph website, including text, graphics, logos, and software, is the property of NEXARLABS LTD or its licensors and is protected by intellectual property laws.
Purchased data is licensed for your use under the terms described in Section 6. No ownership of the underlying data or methodology is transferred to you.
10. Termination
- We may suspend or terminate your access to DeedGraph at any time if you violate these Terms, with or without notice.
- You may stop using our services at any time.
- Upon termination, your right to use any data previously purchased remains subject to the usage restrictions in Section 6.
- Any outstanding payments remain due upon termination.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of DeedGraph after changes are posted constitutes acceptance of the updated Terms.
For material changes, we will make reasonable efforts to notify existing customers via email.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of DeedGraph shall be subject to the exclusive jurisdiction of the courts of England and Wales.
